COTE LLC (“Côte”, “we” or “us”) respects your privacy and we are committed to protecting the privacy of our customers' personal information, and this privacy policy (“Privacy Policy” or “Policy”) is designed to voluntarily comply with current privacy legislation. We currently operate the website http://www.coteshop.co (the “Site” or “website”), including all of its sub sites and all software, applications, products, features, and services made available, displayed or offered by or through our website or sub sites (collective, the “Site”). This Privacy Policy is incorporated into, and part of the Terms of Use (the “Terms of Use”), which governs your use of this Site in general. This Site is published and maintained on behalf of Cote, with offices located at 10850 Wilshire Blvd, Los Angeles, CA 90024.

When you purchase something from our online store, whether through our Site or mobile application, as part of the buying and selling process we collect the personal information you give us such as your name, address, email address, telephone number, and credit or debit card number. When you browse our online store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Even if you do not make a purchase on our Site, we have the ability to track usage of our website, including what pages are visited, what products are viewed, and the third-party sites that led you to our site. Other information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons and other tracking technologies, including information about your internet connection, the equipment you use to access our Site and usage details. This information is not used to track information about individuals, but is used at an aggregate level to customize our site, improve the online experience, and plan advertising and promotions.

SECTION 2 - CONSENT

 When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we infer that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. SECTION 3 - DISCLOSURE

Cote does not sell or otherwise share your personal information with anyone else, such as advertising agencies or marketing companies. We only send marketing information to those customers who specifically sign up for our mailing list. Marketing information sent by Cote may be sent by us as part of a cross-promotion or other collaboration with other companies or brands, but we do not disclose personal information to such companies or brands.

 Cote will share your personal information internally with those staff members who need it to complete your purchase or carry out your instructions regarding the receipt of marketing information. Authorized Cote service providers may also have access to this information in order to carry out their responsibilities directly connected with the processing of your purchases or handling of customer service issues.

We may disclose aggregated anonymous information about our users, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Cote’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by Cote about our Site users is among the assets transferred.
  • To third parties to market their products or services to you if you have not opted out of these disclosures.
  • To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use the "e-mail a friend" feature of our Site, we will transmit the contents of that e-mail and your e-mail address to the recipients.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including responding to any government or regulatory request.
  • To enforce or apply our terms of use CoteShop.co/terms or terms of sale www.CoteShop.co/termsofsale and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Cote, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Outside of these activities, we will not disclose your personal information to any third party without your written consent unless required to do so by law. 

SECTION 4 - SHOPIFY

 Our online store is hosted by Shopify Inc. (“Shopify”). Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s databases and software application. Shopify stores your data on a secure server behind a firewall.

 Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our online store and its service providers. Cote does not currently retain credit card numbers internally.

SECTION 5 - SECURITY

 No method of transmission over the Internet or electronic storage is 100% secure. However, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 6 – COOKIES AND DATA

 Cote, as with many other websites, makes use of "cookies" to help deliver a better customer shopping experience. Cookies are alphanumerical identification elements that we transfer to the hard drive of your computer via your web browser. They enable our systems to recognize your browser and to offer you value-added services, such as saving the contents of your shopping basket and to deliver a more personalized shopping experience. Most Internet web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Additionally, if you have a Flash player installed on your computer, your Flash player can be set to reject or delete Flash cookies. However, refusing a cookie may, in some cases, preclude you from using, or negatively impact the display or function of, the Site or certain areas or features of the Site.

We may use “clear GIFs” (aka “web beacons” or “pixel tags”) or similar technologies, in the Site and/or in our communications with you to enable us to know whether you have visited a Web page or received a message. A clear GIF is typically a one-pixel, transparent image (although it can be a visible image as well), located on a webpage or in an e-mail or other type of message, which is retrieved from a remote site on the Internet enabling the verification of an individual’s viewing or receipt of a Web page or message. A clear GIF may enable us to relate your viewing or receipt of a Web page or message to other information about you, including your Personal Information.

 Our server automatically collects data about your server’s Internet address when you visit us. This information, known as an Internet Protocol address, or IP Address, is a number that’s automatically assigned to your computer by your Internet service provider whenever you’re on the Internet. When you request pages from our Site, our servers may log your IP Address and sometimes your domain name. Our server may also record the referring page that linked you to us (e.g., another website or a search engine); the pages you visit on this Site; the Web site you visit after this Site; the ads you see and/or click on; other information about the type of Web browser, computer, platform, related software and settings you are using; any search terms you have entered on this Site or a referral site; and other Site usage activity and data logged by our Site servers. We use this information for internal system administration, to help diagnose problems with our server, and to administer our Site. Such information may also be used to gather broad demographic information, such as country of origin and Internet Service Provider. We may also link this information with your personal information, but will not share such information, when linked with your personal information, with a third party without your prior consent.

 Any or all of these activities with regard to Site usage information may be performed on our behalf by our service providers.

Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

SECTION 7 - AGE OF CONSENT

 By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any minors under your care to use this site.

SECTION 8 - CHANGES TO THIS PRIVACY POLICY

 We reserve the right to modify this privacy policy at any time. Changes and clarifications will take effect immediately upon their posting on this website

If our company is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

SECTION 9 - YOUR CALIFORNIA PRIVACY RIGHTS

 California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We also may disclose user information when we have reason to believe that someone is causing injury to or interference with our rights or property, other users of the Site, or anyone else that could be harmed by such activities. If we are required or compelled to disclose your user information by a government authority, we may attempt to notify you of such disclosure if we are permitted to do so by law.

You have the right to “opt in” and “opt out” of certain of our uses of your Personal

Please understand that if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.
